Please read these terms and conditions carefully before using Our Service.
Introduction
Welcome to FrontRx. These Terms and Conditions govern Your access to and use of Our Service.
By using FrontRx, You agree to comply with these Terms. If You do not agree, You must not use the Service.
Definitions
Company (“We”, “Us”, “Our”) refers to Pillow Health Inc., 2247 Rue Coursol, Montreal, QC, Canada.
Service refers to the FrontRx platform (www.frontrx.com) and any associated software, APIs, or mobile applications.
User (“You”) refers to any individual or legal entity accessing or using the Service.
Enterprise User refers to any business entity, including but not limited to hospitals, clinics, and healthcare institutions.
Patient refers to any individual under the care of a User who utilizes the Service to document and manage patient information.
Account refers to a unique user profile created to access and use the Service.
Subscription refers to paid plans granting access to specific features of the Service.
Personal Data refers to information that identifies or can be used to identify an individual.
De-Identified Data refers to information that has been stripped of direct identifiers such as first name, last name, patient ID, and date of birth to prevent identification.
Data Collection, Retention & Compliance
3.1. Zero Retention of Audio Data
- FrontRx does not store or retain any audio recordings.
- Once an audio file is transcribed, it is immediately deleted from our systems.
3.2. Data We Collect from Users
We collect and retain only the following professional information for registered users (such as physicians and healthcare providers):
- First and last name
- Professional license number
- Practice address
- Fax number
- Medical specialty
This information is necessary for account management, regulatory compliance, and communication between Users.
3.3. De-Identification of Patient Data
- Any medical notes generated through FrontRx’s AI services are automatically de-identified before any storage or processing.
- We remove identifiable patient details (first name, last name, patient ID, date of birth) before AI processing.
- De-identified medical summaries may be used to improve AI performance, but cannot be traced back to any individual.
3.4. Data Hosting & Security Compliance
- All data is hosted exclusively in Canada, with storage in Quebec when required by law.
- We comply with PIPEDA (Canada), Quebec Law 25, and applicable medical privacy regulations.
- No data is transferred outside of Canada without explicit user consent and legally required safeguards.
User Responsibilities
4.1. Responsibilities for Individual Users
- Users must ensure the accuracy of the information they input into the platform.
- Users are responsible for maintaining the confidentiality of their login credentials.
- Users must comply with all relevant medical and privacy laws when using the Service.
4.2. Responsibilities for Enterprise Users (Hospitals, Clinics, Institutions)
Enterprise Users must:
- Ensure compliance with all applicable patient privacy laws and regulations.
- Obtain patient consent before entering patient data into the Service.
- Limit access to authorized personnel only.
Enterprise Users acknowledge that FrontRx does not assume liability for patient data entered into the system without proper consent.
Subscriptions & Billing
5.1. Subscription Plans and Auto-Renewal
- The Service is available through paid Subscription plans billed on a recurring basis.
- Subscriptions automatically renew unless canceled before the renewal date.
5.2. Cancellation & Refunds
- Users may cancel a Subscription at any time, but fees already paid are non-refundable.
- Refunds may be granted on a case-by-case basis at the sole discretion of the Company.
5.3. Billing Information
Users must provide accurate and complete billing details, including:
- Full name, practice address, and payment details.
- Failure to process payment will result in suspension or termination of the Subscription.
Account Security & Access Control
- Users must keep their login credentials confidential and report any unauthorized access immediately.
- FrontRx reserves the right to suspend or terminate accounts suspected of unauthorized or fraudulent use.
Content & User Contributions
7.1. User-Generated Content
Users may upload clinical notes, medical summaries, and other relevant documents. By doing so, Users affirm that:
- They own or have permission to upload the content.
- They have obtained patient consent where applicable.
- The content does not violate any laws, regulations, or ethical guidelines.
7.2. Restrictions on Content
Users must not upload:
- Patient data without proper consent.
- Unlawful, defamatory, or offensive content.
- Content that infringes on third-party rights.
FrontRx reserves the right to remove content that violates these terms.
Limitation of Liability
8.1. No Medical Advice
FrontRx does not provide medical advice. The Service is a documentation tool, and Users are solely responsible for patient care decisions.
8.2. Limitation of Liability
To the fullest extent permitted by law:
- FrontRx is not liable for any errors, omissions, or harm resulting from the use of the Service.
- FrontRx’s maximum liability is limited to the amount paid by the User for the Subscription in the last 12 months, or $100 USD if no payment was made.
8.3. “As-Is” Disclaimer
The Service is provided “as is” and “as available”, without warranties of any kind.
Termination & Account Suspension
- FrontRx may terminate or suspend accounts at its sole discretion for violations of these Terms.
- Upon termination, access to the Service will cease immediately.
Governing Law & Dispute Resolution
- These Terms are governed by the laws of Quebec, Canada.
- Disputes will be resolved through arbitration in Montreal, Quebec unless otherwise required by law.
Updates to These Terms
- FrontRx reserves the right to update these Terms.
- Users will be notified of material changes at least 30 days in advance.
- Continued use of the Service after updates constitutes acceptance of the new Terms.
